Results may vary based on numerous factors including but not limited to client implementation, market conditions, and business practices.

4. Account Usage and Responsibilities

When using our services, you agree to:

Custom work developed specifically for clients may be subject to separate intellectual property agreements as outlined in individual service contracts.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. You acknowledge that your use of our services is at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHARCON AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Sharcon AI and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses arising out of or relating to your use of our services or violation of these terms.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the federal or state courts located in Delaware.

11. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

CLASS ACTION WAIVER: You agree that any arbitration or legal proceeding shall be limited to the dispute between you and Sharcon AI individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms of Service. Upon termination, your right to use our services will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new terms on our website. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
